General Terms and Conditions

A contract that has been concluded for a definite period and which extends to the regular delivery of products (including electricity) or services may not be tacitly extended or renewed for a fixed duration.

Notwithstanding the above, a contract that has been concluded for a definite period and which extends to the regular delivery of daily, weekly, and monthly newspapers and magazines may be tacitly extended for a maximum of three months, provided the consumer can terminate this extended contract towards the end of the extension with a notice period of no more than one month.

A contract that has been concluded for a definite period and which extends to the regular delivery of products or services may only be tacitly extended for an indefinite period if the consumer may terminate at any time with a notice period of no more than one month, and in the case of contracts for the regular but less than monthly delivery of daily, weekly, and monthly newspapers and magazines, with a notice period of no more than three months.

A fixed-term contract for the regular delivery of daily, weekly, and monthly newspapers and magazines for introductory purposes (trial or test subscription) shall not be tacitly extended and terminates automatically after the expiry of the trial or introductory period.

Duration

If a contract has a term of more than one year, the consumer may terminate the contract at any time after the expiry of one year with a notice period of no more than one month, unless good faith precludes termination before the end of the agreed term (cf. §§ 314, 323 of the German Civil Code).

Article 13 – Payment

Unless otherwise agreed, amounts owed by the consumer must be paid within 7 working days after the commencement of the withdrawal period in accordance with § 355 of the German Civil Code. In the case of a service contract, this period begins after the consumer has received the contract confirmation.

The consumer is obliged to immediately report any errors in the provided payment details to the entrepreneur.

In the event of default in payment, the entrepreneur has the right, subject to statutory limitations, to charge the consumer for reasonable costs previously made known (cf. §§ 280, 286 of the German Civil Code).

Article 14 – Complaints procedure

Complaints regarding the performance of the contract must be submitted fully and clearly to the entrepreneur within 7 days of identifying the defect.

Complaints submitted to the entrepreneur will be answered within 14 days of receipt. Should a longer processing time be required, the entrepreneur will inform the consumer within this period that the complaint has been received and provide an estimated response time.

If the complaint cannot be resolved by mutual agreement, a dispute arises that is eligible for a conciliation procedure.

A complaint does not suspend the entrepreneur's obligations, unless otherwise stated in writing.

If the complaint is recognized as justified by the entrepreneur, the latter will, at their discretion, replace or repair the delivered products free of charge.

Article 15 – Disputes

Contracts between the entrepreneur and the consumer to which these general terms and conditions apply are governed exclusively by German law, even if the consumer is domiciled abroad.
